The Archbishop of Newark took the witness stand Thursday in the case filed by the family whose daughter successfully fought to allow her to play on her Catholic school's boys' basketball team only to have her and her sister tossed from the school this coming fall. The family of Sydney Phillips sued the archdiocese after St. Theresa School in Kenilworth refused to allow her to play on the boys' basketball team, because there was no girls' team. During the lawsuit, Phillips and her sister were expelled but Cardinal Joseph Tobin allowed them back. He testified that the girls were told they could not enroll in the fall because the litigation was disruptive.
Their family is now suing the archdiocese to allow them back in.
